The Dual Impact of Housing Market Regulation in the Netherlands: A Critical Analysis of the Proposed Act on Temporary Rental Contracts

Regulating the housing market is a topic that often sparks intense political engagement and action. Hugo de Jonge’s recently proposed legislation regarding temporary rental contracts has drawn particular attention. In this blog post, we focus on some critical aspects of the proposed law and its potential impact on the Dutch housing market.

Legislation banning temporary rental contracts (passed on 14 November 2023):

A ban on temporary rental contracts means that fixed-term rental agreements are not permitted. Rental contracts must instead be for an indefinite period, offering tenants greater security of tenure while providing landlords with less flexibility.

Distortion of market forces

Excessive regulation of the housing market can disrupt its natural functioning. Too many rules can cause price distortions and artificial constraints on supply and demand. This can result in an imbalance and a lack of flexibility to adapt to changing circumstances.

Reduced Appeal to Investors

Strict regulations can deter potential investors by limiting returns on real estate investments. In the short term, this may lead to reduced investor interest, potentially restricting the availability of capital for new construction and renovation and thereby hindering growth in the real estate market.

Potential Delay of New Construction Projects.

Although regulation may be intended to increase housing accessibility, excessive administrative burdens and strict rules can discourage developers from launching new projects. This can reduce the supply of new homes and drive up prices due to delays in new construction.

Creation of Scarcity and Increasing Bureaucracy

Excessive regulation can lead to scarcity, where demand outstrips supply. This can result in long waiting lists and limited choices for those seeking housing. Furthermore, complex regulations can create bureaucratic hurdles that make it difficult for both developers and buyers to navigate the process.

Unintended market distortions

Regulation can have unforeseen consequences that disrupt the market. For example, attempts to freeze prices can reduce the incentive for owners to invest in their properties or develop new projects. This can ultimately lower the quality of housing and infrastructure.
